Appeals Guide - The Appeals Process
There are two levels of appeal in the Department. The first or lower appeal is filed to the Appeal Tribunal. This is a
separate and independent unit of the Department which has a staff
of Hearing Officers who hear and decide appeals.
The second or higher appeal is to the Department itself. These second
level appeals are decided by the Commissioner of Labor. In most cases, you must receive a decision from the Appeal Tribunal before you can appeal to the Department. If you disagree with the Department's decision, you can file an appeal to Superior
Court.
